These Terms of Service ("Terms") are an agreement between you and Rough Seas LLC ("Rough Seas," "we," "us," or "our"). They govern your access to and use of www.roughseasproductions.com (the "Website"), purchases, event registrations, communications, and other services offered through the Website (collectively, the "Services").
By accessing the Website, creating an account, placing an order, registering for an event, or otherwise using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 18 years old and legally able to enter into a binding agreement to make a purchase, register for an event, create an account, or enroll in marketing communications. A parent or legal guardian may purchase a product or register for an age-appropriate event on behalf of a minor.
2. Changes to These Terms
We may update these Terms periodically. Updated Terms will be posted on this page with a revised effective date. Changes apply prospectively unless applicable law requires otherwise. Your continued use of the Services after updated Terms become effective constitutes acceptance of those changes.
3. Website Access and Accounts
You are responsible for providing accurate information, protecting your account credentials, and promptly notifying us of suspected unauthorized access. We may suspend or terminate access when reasonably necessary to protect the Website, our customers, or our business; investigate suspected fraud or unlawful activity; or address a material violation of these Terms.
We may modify, suspend, or discontinue any part of the Website. We do not guarantee that the Website will always be available, uninterrupted, secure, or error-free.
4. Products, Descriptions, and Availability
We make reasonable efforts to display product descriptions, ingredients, colors, sizes, photographs, availability, and prices accurately. Because our teas and botanical products may contain natural or handcrafted ingredients, appearance, aroma, flavor, color, texture, and packaging may vary between batches. Product photographs are illustrative, and device displays and lighting may affect how colors appear.
Products and services are subject to availability. We may limit quantities, discontinue an item, correct an error, or decline or cancel an order for legitimate reasons, including suspected fraud, pricing or inventory errors, or inability to fulfill the order. If we cancel an order after collecting payment, we will refund the amount paid for the canceled portion to the original payment method.
5. Prices, Payment, and Taxes
Prices are shown in U.S. dollars unless otherwise stated. Applicable taxes, shipping charges, service charges, and other disclosed fees will be presented before checkout.
You authorize us and our payment processor to charge the payment method provided for the total shown at checkout. You represent that you are authorized to use that payment method.
We may correct an inadvertent pricing or description error before accepting or fulfilling an order. If a correction materially affects your order, we will allow you to accept the correction or cancel the affected item for a refund.
An automated order acknowledgment confirms receipt but does not necessarily constitute acceptance. Acceptance occurs when we confirm fulfillment, ship the product, or otherwise expressly accept the order.
6. Shipping and Delivery
Shipping estimates are estimates and are not guarantees unless expressly identified as guaranteed. You are responsible for providing a complete and accurate delivery address.
If we cannot ship within the time stated at purchase or, when no time is stated, within the period required by law we will provide notice and any legally required opportunity to agree to the delay or cancel the unshipped portion for a refund.
Risk of loss and title pass as provided by applicable law. Nothing in these Terms limits rights you may have concerning merchandise that is not delivered, arrives damaged, or does not conform to the order.
Additional shipping terms are contained in the Shipping Policy posted on the Website. If these Terms conflict with a transaction-specific promise made at checkout, the transaction-specific promise controls for that purchase.
7. Returns, Refunds, and Order Problems
Returns, replacements, credits, and refunds are governed by the Refund Policy displayed on the Website and any terms disclosed at checkout. Those policies are incorporated into these Terms by reference.
Contact info@roughseasproductions.com promptly if an order is missing, incorrect, damaged, or defective. Include the order number and reasonable documentation of the issue.
Nothing in these Terms or a separate policy limits any refund, replacement, cancellation, or warranty right that cannot legally be waived.
8. Events, Workshops, and Experiences
Event and workshop registrations may be subject to additional terms displayed on the event page or at checkout, including attendance requirements, age restrictions, cancellation deadlines, transfer rules, and refund eligibility. Those disclosed terms are incorporated into these Terms.
Event schedules, instructors, locations, menus, activities, and materials may change for reasons outside our reasonable control. If Rough Seas cancels an event, registered participants will receive the remedy stated in the event listing or otherwise required by law.
Participants must follow reasonable safety instructions and venue rules. A participant may be removed for dangerous, disruptive, harassing, or unlawful conduct. Removal for such conduct does not create a right to a refund except where required by law.
Some events may be photographed or recorded. We will provide notice when event photography or recording is planned. Any use of an identifiable attendee's image for promotional purposes will be handled in accordance with applicable law and any release or consent presented for that event.
9. Food, Herbal Products, Allergies, and Wellness Information
Our teas, botanical products, workshops, product descriptions, educational materials, and statements are provided for general food, educational, and wellness purposes. They are not medical advice and are not intended to diagnose, treat, cure, or prevent any disease.
Ingredients may cause allergic reactions, sensitivities, or interactions. Read the complete product label and ingredient list before use. Contact us before purchasing if you need additional ingredient information.
Consult a qualified healthcare professional before using herbal products if you are pregnant, nursing, taking medication, managing a medical condition, preparing for surgery, or giving a product to a child. Stop use and seek appropriate medical attention if you experience an adverse reaction.
We make reasonable efforts to provide accurate ingredient and allergen information. Products may be prepared, stored, or packaged in environments where other ingredients are present. Any specific allergen or cross-contact statement on the product label controls.
These provisions do not exclude or limit responsibility for product safety, accurate labeling, negligence, or any other obligation that cannot be excluded under applicable law.
10. Intellectual Property
The Website and its original content—including text, photographs, graphics, logos, product names, blend names, event materials, videos, designs, and arrangement—are owned by or licensed to Rough Seas and protected by intellectual-property laws.
We grant you a limited, revocable, nonexclusive, nontransferable license to access and use the Website for lawful personal purposes. Without prior written permission, you may not reproduce or commercially exploit Website content; remove proprietary notices; use our names, logos, photographs, recipes, workshop materials, or designs in a way that suggests endorsement; or systematically scrape Website content except as permitted by law.

11. Reviews and Other User Content
If you submit a review, photograph, comment, or other content ("User Content"), you retain ownership. You grant Rough Seas a nonexclusive, worldwide, royalty-free license to host, reproduce, display, and distribute that User Content as reasonably necessary to operate, promote, and improve the Services.
You represent that you have the rights necessary to submit the User Content and that it does not violate another person's intellectual-property, privacy, publicity, or other rights. We may remove content that is unlawful, fraudulent, abusive, misleading, infringing, unrelated, or otherwise violates these Terms.
12. Prohibited Conduct
You may not:
- Use the Services for unlawful, fraudulent, or deceptive purposes;
- Attempt to gain unauthorized access to accounts, systems, or data;
- Introduce malicious code or interfere with Website operation;
- Impersonate another person or misrepresent your affiliation;
- Scrape or use automated tools in a manner that materially burdens or disrupts the Website;
- Infringe intellectual-property, privacy, publicity, or other legal rights;
- Submit false reviews, harmful content, spam, or unauthorized promotions; or
- Threaten, harass, or harm another person through the Services.
13. Copyright Concerns
If you believe material on the Website infringes your copyright, send a written notice to info@roughseasproductions.com identifying the copyrighted work, the allegedly infringing material and its location, your contact information, a statement of good-faith belief, a statement under penalty of perjury that the information is accurate and you are authorized to act for the copyright owner, and your physical or electronic signature.
14. Third-Party Services and Links
The Website may link to or integrate with third-party payment, ticketing, social-media, shipping, and e-commerce services. We do not control third-party services and are not responsible for their content, availability, security, or independent practices. Your use of a third-party service may be governed by that provider's terms and privacy policy.
15. SMS/Text Messaging Terms
Program Name and Consent
The Rough Seas LLC and Rough Seas Teas Text Messaging Program is operated by Rough Seas LLC, doing business as Rough Seas Teas.
By voluntarily providing your mobile number and opting in, you consent to receive recurring automated and non-automated text messages from Rough Seas at the number provided. Consent to receive marketing messages is not a condition of purchasing any product or service.
You represent that you are the subscriber or customary user of the mobile number and are authorized to consent to messages at that number.
Types of Messages
Messages may include customer-care communications, order and shipping updates, pickup notifications, event or workshop confirmations and reminders, product announcements, marketing messages, promotional offers, and other Rough Seas business updates.
Frequency and Charges
Message frequency varies. Message and data rates may apply.
Cancellation

You may also revoke consent through another reasonable method by emailing info@roughseasproductions.com. We will honor valid revocation requests within the period required by applicable law. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY FOR A CLAIM ARISING FROM A PARTICULAR PURCHASE OR EVENT WILL NOT EXCEED THE AMOUNT YOU PAID TO ROUGH SEAS FOR THAT PURCHASE OR EVENT.
THESE LIMITATIONS DO NOT APPLY TO FRAUD, WILLFUL MISCONDUCT, GROSS NEGLIGENCE, PERSONAL INJURY CAUSED BY NEGLIGENCE, PRODUCT-LIABILITY OBLIGATIONS, OR ANY LIABILITY OR REMEDY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.
Some jurisdictions do not permit certain limitations, so some or all of this section may not apply to you.
19. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Rough Seas and its owners, employees, and agents from third-party claims, damages, or reasonable costs arising from your unlawful conduct, material violation of these Terms, or User Content that infringes another person's rights.
This provision does not require you to indemnify Rough Seas for its own negligence, unlawful conduct, or breach of these Terms.
20. Governing Law
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles, because Rough Seas LLC is organized in Pennsylvania. This choice of law does not deprive you of mandatory consumer protections provided by the law of your state of residence.
The parties consent to the jurisdiction of state and federal courts that have lawful jurisdiction over the dispute. Nothing in these Terms prevents either party from bringing an eligible matter in small-claims court.
21. Severability, Waiver, and Assignment
If a provision is held invalid or unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver.
You may not assign your rights or obligations under these Terms without our written consent. We may assign these Terms in connection with a merger, reorganization, sale of assets, or other lawful business transfer.
22. Entire Agreement
These Terms, the Privacy Policy, and any shipping, refund, event, or transaction-specific terms displayed to you constitute the agreement between you and Rough Seas concerning the Services. Transaction-specific terms control only to the extent they directly conflict with these general Terms.
